ONLINE STORE REGULATIONS

§ 1. GENERAL PROVISIONS AND DEFINITIONS

1.1. General Provisions

  1. This Regulations specifies the principles and conditions for using the Online Store and the principles and conditions for selling E-books through the Store.
  2. The Regulations was prepared in accordance with applicable provisions of Polish law and the European Union law, in particular with:

Act of 23 April 1964 Civil Code

Act of 30 May 2014 on Consumer Rights

Act of 18 July 2002 on the provision of services by electronic means

Regulation of the European Parliament and of the Council (EU) 2016/679 (GDPR)

  1. The Regulations is available free of charge on the Store's website in a form enabling its download, saving and printing.
  2. A condition for using the Store is familiarization with the content of the Regulations and its acceptance.
  3. Acceptance of the Regulations occurs by marking the appropriate checkbox when placing an Order.

1.2. Definitions

Terms used in the Regulations mean:

Seller – a natural person conducting unregistered business activity within the meaning of Article 5 of the Act of 6 March 2018 on Entrepreneurs' Rights, with the following data:

Customer – a natural person, legal entity or organizational unit without legal personality, which intends to enter into or has entered into a Purchase Agreement with the Seller.

Consumer – a natural person performing a legal act with the Seller not directly related to their business or professional activity.

Entrepreneur on consumer rights – a natural person entering into a contract directly related to their business activity, when it follows from the content of this contract that it does not have a professional character for that person.

Store or Online Store – an internet service available at [DOMAIN_NAME], through which the Customer can place Orders.

E-book – digital content in the form of an electronic publication (electronic book) in PDF, EPUB or other electronic format, constituting the Product offered in the Store.

Product – an E-book available in the Store, being the subject of the Purchase Agreement.

Order – a statement of will of the Customer aimed directly at concluding a Purchase Agreement, specifying in particular the type and number of Products.

Purchase Agreement – an agreement for the sale of digital content (E-book) concluded between the Customer and the Seller through the Online Store.

Price – value expressed in monetary units (Polish zloty PLN or euro EUR), which the Customer is obliged to pay to the Seller for the Product.

Account – an individual space assigned to a specific Customer, available after logging in, through which the Customer can make purchases and manage their data.

§ 2. TECHNICAL CONDITIONS FOR USING THE STORE

2.1. Technical Requirements

  1. Using the Store requires meeting the following minimum technical requirements:

Possession of a device with Internet access (computer, tablet, smartphone)

Access to an active e-mail account (e-mail)

Web browser supporting JavaScript, cookies and SSL/TLS encryption

Software enabling reading of files in formats offered by the Seller (e.g. PDF reader, EPUB)

  1. The Seller recommends using current versions of web browsers (Chrome, Firefox, Safari, Edge).
  2. For proper use of E-books, it is necessary to have appropriate software or a device enabling reading of files in the format in which the E-book was delivered.

2.2. Security and Data Protection

  1. The connection between the Customer's browser and the Store is encrypted using the SSL/TLS protocol.
  2. The Seller applies technical and organizational measures ensuring the protection of processed personal data in accordance with GDPR requirements.
  3. Detailed information regarding the processing of personal data is contained in the Privacy Policy available on the Store's website.

§ 3. ESTABLISHING AND USING AN ACCOUNT

3.1. Account Registration

  1. Establishing an Account in the Store is voluntary, but may be required to place an Order.
  2. Registration occurs by filling out the registration form available on the Store's website.
  3. In the registration form, the Customer provides the following data:

Name and surname

Email address

Access password to the Account

  1. After completing the form, the Customer receives an email message with an activation link or registration confirmation.
  2. The Customer is obliged to provide true, current and complete data.

3.2. Login and Account Security

  1. Access to the Account occurs by providing an email address and a password established by the Customer.
  2. The Customer is obliged to maintain the confidentiality of the Account access data.
  3. The Customer is responsible for all activities carried out using their Account.
  4. In case of suspicion of unauthorized access to the Account, the Customer is obliged to immediately inform the Seller.

3.3. Account Deletion

  1. The Customer may at any time request deletion of the Account by sending an appropriate email to the Seller's address.
  2. The Seller may delete the Customer's Account in case of flagrant violation of the Regulations.
  3. Deletion of the Account does not affect the validity of previously concluded Purchase Agreements.

§ 4. PRODUCTS AND PRICES

4.1. Presentation of Products

  1. The Store presents E-books available for purchase along with the following information:

Title of the E-book

Description of content

File format (PDF, EPUB, etc.)

Number of pages or volume

Language

Gross price

  1. All photographs, graphics and descriptions presented in the Store are for illustrative purposes.
  2. The Seller reserves the right to change the content presented in the Store, including the description and prices of Products, without prejudice to rights acquired by the Customer, including in particular the conditions of Purchase Agreements concluded before the change.

4.2. Prices and Promotions

  1. All prices given in the Store are gross prices (including VAT) and are expressed in dollars ($)
  2. The price indicated at the Product is binding at the time the Customer places the Order.
  3. In the case of running a promotion, the Seller provides the lowest price of the Product applicable in the 30 days before the promotion was introduced, in accordance with the requirements of the Omnibus Directive.
  4. Promotions may be limited in time or quantity – detailed conditions of the promotion are specified in the regulations of the promotion.
  5. The final price includes all components, including any handling fees – in the case of E-books delivered digitally, additional costs usually do not occur.

§ 5. PLACING ORDERS

5.1. Order Placement Procedure

  1. To place an Order, the Customer:

Selects a Product (E-book) and adds it to the basket

After completing the selection of Products, proceeds to the Order summary

Provides the data necessary for the implementation of the Order (name, surname, email address)

Selects a payment method

Marks the field confirming familiarization with and acceptance of the Regulations and Privacy Policy

Approves the Order by clicking the "I order with an obligation to pay" button or equivalent

  1. Placing an Order is a statement of will to conclude a Purchase Agreement with an obligation to pay.
  2. After placing the Order, the Customer receives a confirmation of acceptance of the Order for processing at the provided email address.

5.2. Confirmation and Implementation of Order

  1. The Purchase Agreement is concluded when the Customer receives an email confirming the acceptance of the Order for processing.
  2. The Seller reserves the right to refuse to process the Order in case of:

Providing false or incomplete data by the Customer

Previous failure of the Customer to fulfill obligations to the Seller

Suspicion of action contrary to law or the Regulations

  1. In case of refusal to process the Order, the Seller informs the Customer of this electronically.

§ 6. PAYMENTS

6.1. Payment Methods

  1. The Seller provides the following payment methods:

Electronic payments through payment operators (e.g. Przelewy24, PayU, Stripe, PayPal)

Traditional bank transfer to the Seller's bank account

  1. Detailed information about available payment methods is presented to the Customer during Order placement.
  2. In case of choosing electronic payment, the Customer is redirected to the payment gateway of an external operator.
  3. In case of choosing a traditional transfer, the Customer receives transfer details in the Order confirmation.

6.2. Time of Payment

  1. The Customer is obliged to make payment within 3 business days from the time of placing the Order, unless the Regulations state otherwise.
  2. Non-payment of the Order within the specified period is equivalent to the Customer's withdrawal from the Purchase Agreement.
  3. In the case of electronic payments, the E-book is usually sent within a few minutes of confirmation of payment.
  4. If the E-book has not been delivered within the expected period, the Customer is obliged to contact the Seller.
  5. The Seller may extend the period for delivery of the E-book to a maximum of 15 days, which will be communicated to the Customer before the conclusion of the Purchase Agreement.

§ 7. DELIVERY OF E-BOOKS

7.1. Method and Terms of Delivery

  1. E-books are delivered exclusively in electronic form, to the email address provided by the Customer when placing the Order.
  2. The E-book is delivered to the Customer immediately after the payment is credited to the Seller's account, but no later than within 24 hours from the time of receipt of payment.

7.2. Delivery Verification

  1. The Customer is obliged to check the correctness of the received E-book immediately after delivery.
  2. In case of technical problems with opening or reading the file, the Customer should immediately contact the Seller.

§ 8. RIGHT OF WITHDRAWAL FROM CONTRACT

8.1. Exclusion of Right of Withdrawal for Digital Content

  1. The Customer, being a Consumer or an Entrepreneur on consumer rights, DOES NOT have the right to withdraw from the Purchase Agreement concerning the delivery of digital content (E-book), if the performance of the service began at their express consent before the withdrawal period expired and after being informed by the Seller of the loss of the right to withdraw.
  2. In accordance with Article 38 paragraph 13 of the Consumer Rights Act, the right of withdrawal from a contract concluded outside the business premises or at a distance does not apply to the Consumer in the case of contracts for the delivery of digital content not recorded on a material medium, if the performance of the service began at the express consent of the consumer before the withdrawal period expired and after being informed by the entrepreneur of the loss of the right to withdraw from the contract.
  3. By placing an Order, the Customer agrees to the immediate commencement of the performance of the service (delivery of E-book) and is simultaneously informed of the loss of the right to withdraw from the Purchase Agreement.

8.2. Withdrawal Form (for Cases Where the Right Applies)

  1. In cases where the right of withdrawal applies (e.g. when the E-book has not been delivered), the Consumer may use the template of the withdrawal form, which is an attachment to these Regulations.
  2. Withdrawal from the Agreement may also occur by submitting an unambiguous statement of withdrawal sent to the Seller's email address.

§ 9. COMPLAINTS AND LIABILITY FOR DEFECTS

9.1. Basis of Liability

  1. The Seller is liable to the Customer being a Consumer or an Entrepreneur on consumer rights for lack of conformity of digital content (E-book) with the contract in accordance with the provisions of the Consumer Rights Act.
  2. The E-book is in conformity with the contract, if:

Corresponds to the description, type, quantity and has the features presented by the Seller

Is suitable for the purposes for which E-books of this kind are usually used

Is delivered in the described format and is complete

9.2. Filing Complaints

  1. The Customer may file a complaint regarding non-conformity of the E-book with the contract:

  1. It is recommended that the complaint contains:

Customer's contact data

Description of the non-conformity of the E-book with the contract

Customer's request (e.g. replacement, repair, price reduction)

Order number or purchase date

  1. A template of the complaint form is available on the Store's website.

9.3. Complaint Resolution

  1. The Seller will respond to the complaint within 14 days from the date of its receipt.
  2. In case of upholding the complaint, the Seller will immediately remove the non-conformity of the E-book with the contract by:

Delivering a corrected version of the E-book

Refunding the paid price (in whole or in part)

Proposing another solution acceptable to the Customer

§ 10. COPYRIGHT AND LICENSE

10.1. Copyright Protection

  1. All E-books offered in the Store are protected by copyright.
  2. By purchasing an E-book, the Customer acquires the right to use the content exclusively for personal use.

10.2. Scope of License

  1. The purchase of an E-book entitles the Customer to:

Download the E-book and save it on your own device

Read the E-book on personal devices (computer, tablet, smartphone, e-book reader)

Make one backup copy for your own needs

  1. The Customer has no right to:

Remove or modify copyright information

Publicly share the E-book

Rent, loan or resell the E-book

Use the E-book for commercial purposes

  1. It is forbidden to copy, distribute, provide to third parties, modify, publish or resell E-books without written consent of the Seller or authorized entity.

10.3. Sanctions for Copyright Infringement

  1. In case of copyright or license infringement, the Seller reserves the right to pursue claims through legal proceedings.
  2. The Customer bears full legal and financial responsibility for copyright infringement.

§ 11. PERSONAL DATA AND PRIVACY POLICY

11.1. Data Controller

  1. The data controller of Customer personal data is the Seller, whose data is provided in § 1.2 of the Regulations.

11.2. Scope of Data Processing

  1. Personal data of Customers is processed for the purpose of:

Concluding and performing the Purchase Agreement (basis: Article 6 paragraph 1 letter b GDPR)

Fulfilling legal obligations incumbent on the Seller (basis: Article 6 paragraph 1 letter c GDPR)

Direct marketing – with the consent of the Customer (basis: Article 6 paragraph 1 letter a GDPR)

Conducting analytical and statistical activities (basis: Article 6 paragraph 1 letter f GDPR – lawful interest of the Seller)

  1. Detailed information on personal data processing, including the Customer's rights, is contained in the Privacy Policy available on the Store's website.

11.3. Customer Rights

  1. The Customer has the right to:

Access to their personal data

Rectification of data

Deletion of data ("right to be forgotten")

Restriction of data processing

Data portability

Objection to data processing

Withdrawal of consent to data processing (if processing is based on consent)

  1. To exercise the above rights, you should contact the Seller.
  2. The Customer has the right to lodge a complaint with the supervisory authority (President of the Office for Personal Data Protection).

§ 12. FINAL PROVISIONS

12.1. Amendment of Regulations

  1. The Seller reserves the right to change the Regulations.
  2. Customers will be informed of changes to the Regulations by publishing a new Regulations on the Store's website along with information about the date of entry into force of the changes.
  3. Amendment of the Regulations does not affect Purchase Agreements concluded before the changes come into force – such agreements are governed by the Regulations applicable on the date the Order was placed.

12.2. Out-of-Court Methods of Complaint Resolution

  1. The Consumer has the opportunity to use out-of-court methods of resolving complaints and claims, in particular through:

Mediation conducted by the competent territorial Provincial Inspector of Trade Inspection

Filing a complaint through the EU online dispute resolution platform ODR: https://ec.europa.eu/consumers/odr

  1. Detailed information is available on the website of the Office for Competition and Consumer Protection: www.uokik.gov.pl

12.3. Applicable Law and Dispute Resolution

  1. The applicable law for Purchase Agreements concluded through the Store is Polish law.
  2. In the case of Consumers, any disputes will be settled by the court competent according to the provisions of the Code of Civil Procedure.
  3. In the case of Customers who are not Consumers, any disputes will be settled by the court competent for the Seller's residence.

12.4. Contact with the Seller

  1. The Seller will make efforts to respond to inquiries within 48 hours (business days).

12.5. Additional Provisions

  1. In matters not regulated in these Regulations, the provisions of Polish law apply, in particular the Civil Code, the Consumer Rights Act, the Act on the Provision of Services by Electronic Means and GDPR.
  2. If any provision of the Regulations is found to be invalid or ineffective, it does not affect the validity of the remaining provisions.
  3. The Regulations enter into force on 21.11.2025
